If {{Isda92prov|Automatic Early Termination}} applies to the {{Isda92prov|Defaulting Party}} and the {{Isda92prov|Event of Default}} it is qualifying {{Isda92prov|Bankruptcy}} event, the {{Isda92prov|Early Termination Date}} will occur: 
:(i) upon the {{Isda92prov|Bankruptcy}} event, if under {{Isda92prov|5(a)(vii)}}(1), (3), (5) or (6) or if analogous, (8); and
:(ii) immediately before institution of the relevant proceeding, if under {{Isda92prov|5(a)(vii)}}(4) or if analogous, (8). <br>
