You may see a liability cap referencing the greater of a percentage of fees or a hard currency amount, though there will be exclusions to that (notably relating to TUPE and other indemnity-type liabilities that would otherwise have been the service provider’s but by operation of legal principles and regulation are transferred onto the customer).
