Compare with section (d)(i) of the ISDA EU Emissions Annex, which in a round about way gets to the same place. comparing the forms of the IETA and the ISDA, tThere has been some curious mutual homework-copying between IETA’s and ISDA’s crack drafting squad™, and in each case the squadspeople concerned seem to have a passing, but not deep, acquaintance with the other’s magisterium. This means both documents get to the same place, in a rather left handed way, but it turns out not to be the place either was meaning to get to.
