There is no Section 2(e) in the 2002 ISDA. But it didn’t go altogether: instead, ISDA’s crack drafting squad™ significantly revamped it and moved it lock, stock and barrel to Section 9(h) (Interest and Compensation). Those who worried they might be missing out on something by staying with the 1992 ISDA} could always sign up for the Section 2(a)(iii)}} Protocol, which brought Section 2(e) into line with the 2002 ISDA’s Section 9(h) (Interest and Compensation).
