Section Relevant Registry in a Nutshell™

Relevant Registry: Means the Registry a party nominates for a particuilar EU Emissions Allowance Transaction. If it has specified multiple Specified Holding Accounts, it will identify the Relevant Registry under Part (d)(i)(2)(C).

Full text of Section Relevant Registry

Relevant Registry: Means the Registry through which a party is obliged to perform a delivery or acceptance obligation under and in accordance with an EU Emissions Allowance Transaction. Where a party has specified more than one Specified Holding Account for delivery or acceptance purposes, the Relevant Registry shall be identified in accordance with Part (d)(i)(2)(C).

The definition of Relevant Registry is more or less the same in all three emissions trading documentation regimes. Compare:

Summary

Did we need a separate definition of “Relevant Registry”? Does it convey any nuance or additional colour that the lower-cased, colloquial, “relevant Registry” does not. In our humble opinion, it does not. Do we really even need the word relevant? In what world, and why, would one be talking about a Registry that was irrelevant?

Do not get us started on all this business about there being more than one Specified Holding Account.
