“Innocent Party” isn’t a sanctioned ISDA definition, but it should be. It is the JC’s cheeky shorthand for “a Non-defaulting Party or a Non-affected Party, as the case may be”. We suggest, weakly, that “a Defaulting Party or Affected Party, as the case may be”, might be an “Implicated Party”. But no one will listen, so this remains expanded ISDA universe fan fiction.
