Original text “Eligible Credit Support” means, with respect to a party, the items, if any, specified as such for that party in Paragraph 11(b)(ii) including, in relation to any securities, if applicable, the proceeds of any redemption in whole or in part of such securities by the relevant issuer. “Equivalent Credit Support” means, in relation to any Eligible Credit Support comprised in the Credit Support Balance, Eligible Credit Support of the same type, nominal value, description and amount as that Eligible Credit Support. No, there is no such term

I know, I know: the term Credit Support does not appear in the 2018 English law IM CSD. But really, it should. If it did, one could avoid a wealth of wasted flannel: “Eligible Credit Support or Equivalent Credit Support as the case may be” kind of thing. And “Delivery Amount or Return Amount as the case may be”.

But when a golden opportunity presents itself, what kind of lawyer can resist spreading flannel far and wide, honestly?
